There are volumes upon volumes of Jazz standards that call for
improvisation, and are all copyrighted.

Software that generates any music, in any way, *is* a fixed score for
the music, unless the software is re-writing itself.  This has been
pointed out already, but the use of a random number generator in some
software does not suddenly make it elusive enough to avoid current
copyright law.
